Founders of Color, LLC (“Founders of Color”, "us", "we", or "our") operates this website, including the webpages and services delivered through the domain foundersofcolor.com (collectively, the "Site"). At Founders of Color, we understand your concerns about privacy and are committed to protecting it through our compliance with this notice.
Founders of Color may modify this Privacy Notice from time to time in our sole discretion. We will provide notice by, at a minimum, updating this posting. You are expected to carefully review this Privacy Notice from time to time so you are aware of any changes. However, if we make material changes to this Privacy Notice, we will notify you either through the email address you have provided us or by means of a prominent notice on the Site before the change becomes effective. By accessing or using the Site, you agree to be bound by any such changes and to Founders of Color’s collection and sharing of your personally identifiable information according to the terms of the then current Privacy Notice.
We collect information you share through the Site. We may collect personally identifiable information, such as your name, gender, race, age, postal address, email address, phone number, social media handle or profile, or any other identifier by which you may be contacted online or offline (collectively, “PII”) only when you have voluntarily provided such PII to us (e.g., through registration, contact inquiries, etc.). We may also collect information concerning you, including, but not limited to, certifications, participation in peer-networking groups, awards, business information and metrics, information about your co-founders and business partners, and the kind of service you are seeking from Founders of Color (collectively, “Business Information”), but only if you voluntarily provide such information to us.
As a general rule, we use the information you voluntarily provide to us, including PII and Business Information, only for the purpose for which you have divulged the data to us, such as to answer your inquiries, grant you access to password protected portions of the Site, or connect you with other founders, investors, partners, clients, or customers. We may also use the information we collect to conduct and share research on our community, including, but not limited to, research briefs and infographics. The community research information that we share would be aggregated and de-identified statistical data and will not include PII.
We may also request information from you in the form of surveys, questionnaires, or comment forms by using third-party apps, social media, or other online survey tools and platforms (collectively, “Surveys”). The Site may include links to these Surveys. This Survey information may include PII and Business Information, but only if you voluntarily provide such PII or Business Information. We may maintain or associate Survey information with information we collect through the Site. Information collected from Surveys may be used (a) to connect you with other founders, investors, partners, clients, or customers; (b) for community research purposes (as described above); or (c) for any other purposes indicated by the applicable Survey.
We may use analytics technologies to collect and process certain information about you and your use of the Site. The information collected by the analytics technologies is statistical data and does not include PII or Business Information, and we do not maintain it or associate it with PII or Business Information we collect in other ways or receive from third parties.
Our web server and/or the analytics technologies may collect and store the following general information about you: the originating name of the domain from which you access the Internet; the date and time you access the Site; the pages of the Site you visit; the Internet address of the website from which you linked directly to the Site; and the type of device, device ID and browser you use to access the Site. This information is collected automatically. It is used to help us improve the Site by tabulating the number of visitors to the Site in terms of new users, origin of referrers, popularity of pages, amount of use, and types of errors, and to make the Site more useful to you.
Our web server and/or the analytics technologies may also collect Internet protocol addresses (the Internet address of a computer) to track a user’s session while the user remains anonymous. We analyze this data for certain trends in statistics, such as which parts of the Site users are visiting and how long they spend there.
We may also use “cookies” and “web beacons.” Cookies are small files stored on your computer’s hard drive that are used to store and track personal information. Cookies are used to remind us of who you are in order to deliver you better service. Web beacons are small electronic files (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Founders of Color, for example, to count users who have visited certain pages and for other related Site statistics (for example, recording the popularity of certain Site content and verifying system and server integrity).
We may also use these automatic data collection technologies to collect information about your online activities over time and across third-party websites or other online services (“Behavioral Tracking”). “Do Not Track” is a proposed standard that is currently under development. As it is not yet finalized, we adhere to the standards set out in this Privacy Notice andwe do not currently respond to “Do Not Track” signals on the Site or on third-party websites or online services where we may collect information.The information we collect automatically is statistical data and does not include PII or Business Information, and we do not maintain it or associate it with PII or Business Information we collect in other ways or receive from third parties.
We do not control these third parties' tracking technologies or how they may be used. If you have any questions about targeted content, you should contact the responsible party directly. For information about how you can opt out of receiving targeted advertising from certain providers, see “Choices About How We Use and Disclose Your Information.”
We may use your PII or Business Information to contact you with information about other founders, investors, partners, clients, or customers, or with newsletters, marketing or promotional materials and other information that is pertinent to the use of the Site. By accessing or using the Site, you are consenting to this.
We do not rent or sell your PII or Business Information to outside marketers. Founders of Color may share your information (as described in this Privacy Notice) with its affiliates, subsidiaries, or divisions and with their respective officers, directors, employees, accountants, attorneys, and agents, or with Founders of Color’s business partners. In certain circumstances, we may share data with vendors to help us provide you with services that you requested from us, perform statistical analysis, send you email or postal mail, or provide customer support. All such third parties are required to maintain the confidentiality of your information and are prohibited from using your PII or Business Information except to provide services to Founders of Color or as required by law.
We may provide information to regulatory authorities and law enforcement officials in accordance with applicable law or when we otherwise believe in good faith that the law requires it. There may be instances when we may access or disclose your information in order to protect or defend the legal rights or property of Founders of Color and its affiliated companies or their employees and agents, to protect the safety and security of users, and to protect against fraud.
Founders of Color may sell, transfer or otherwise share some or all of its assets in connection with a merger, reorganization or sale of assets, or in the event of bankruptcy, without your permission. In such an event, PII and Business Information may be some of the assets transferred.
The Site is developed and supported by third-party vendors, who may in the course of performing their services for us have access to your PII or Business Information. We contractually require such vendors to maintain the confidentiality of your PII and Business Information, and keep your PII and Business Information secure. We do not allow such vendors to use or share your PII or Business Information for any purpose other than in performing services for us.
We strive to provide you with choices regarding the PII and/or Business Information you provide to us. We have created mechanisms to provide you with the following control over your information:
Disclosure of Your Information for Third-Party Advertising.Founders of Color does not share your PII or Business Information with unaffiliated third parties for promotional purposes.
We have implemented measures designed to secure your PII and Business Information from accidental loss and from unauthorized access, use, alteration and disclosure. All information you provide to us is stored on secure servers behind firewalls. Any information you submit to us through the Site will be encrypted during transmission using TLS/SSL technology. Your PII and Business Information is password protected and restricted within our organization to employees and trusted partners that need access to your PII or Business Information in order to correspond with you and provide the services that you requested from us.
The safety and security of your information also depends on you. You must login to access certain parts of the Site. The Site uses third party authentication to verify your login credentials and password. The Site does not store your password or have access to your password. You are responsible for keeping your password confidential. Do not share your password with anyone.
Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your PII and Business Information, we cannot guarantee the security of your PII or Business Information transmitted through the Site. Any transmission of PII or Business Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.
This Privacy Notice is applicable only to the Site and does not apply to any third-party websites or to other companies or persons that may access the Site, with or without our permission. The Site may contain links to, and media and other content from, other websites. In addition, such third-party media and content may also contain external links. Because of the dynamic media capabilities of the Site, it may not be clear to you which links are embedded in the Site and which are embedded in third-party media and/or content. Founders of Color cannot and does not guarantee the privacy policies and practices of any third party. Founders of Color does not control, operate, or endorse any information, products, or services of any third-party websites that may be reached through links from the Site.
The use of any PII or Business Information provided by you to, or automatically collected from, a third party will be governed by that party's privacy notice. If you are unsure whether a website is controlled by, affiliated with, or managed by Founders of Color, you should review the privacy notice at each linked website to determine how that site treats your PII and Business Information.
The Site is not intended for children under 13 years of age. Founders of Color does not knowingly collect PII from children under 13. If you are under 13, do not use or provide any information on the Site or provide any information about yourself to us, including your name, telephone number, email address or any screen name or user name you may use. If we learn we have collected or received PII from a child under 13 without verification of parental consent, we will delete that information. If you have any questions about PII or Business Information that may be retained by Founders of Color, you may contact us email@example.com. Upon your request, Founders of Color will provide to you the PII and Business Information under its control, if any, as well as information about the ways in which that information is being used and disclosed. Founders of Color only collects PII and Business Information for the purposes of providing you with services that you requested from us and the support of those services. Founders of Color will use commercially reasonable efforts to ensure that PII or Business Information we may be using or disclosing is accurate and complete. If you demonstrate that your information is inaccurate or incomplete, the information will be amended as appropriate. We will use commercially reasonable efforts to respond to any request and update your PII or Business Information, if necessary.
California Civil Code Section § 1798.83 permits users of the Site that are California residents to request certain information regarding our disclosure of PII to third parties for their direct marketing purposes. To make such a request, please contact us firstname.lastname@example.org. Please note, however, that Founders of Color does not disclose PII to third parties for their direct marketing purposes.
This Privacy Notice and any disputes related thereto shall be governed by and construed in accordance with the laws of the State of Georgia, exclusive of its choice of law rules.
